The cabinet of the Serbian member and chairman of the Presidency of Bosnia and Herzegovina Milorad Dodik said that all activities undertaken by the institutions of the Republika Srpska in connection with the implementation of the “Upper Drina” project are in accordance with their constitutional and legal competencies, and the statements of Sefik Dzaferovic and other Bosnian politicians are only part of bad political marketing.

– The Commission for Concessions of BiH has no jurisdiction over the property located on the territory of Republika Srpska and a virtuous and experienced lawyer should know that, as Sefik Dzaferovic calls himself, just as he should know that BiH does not have property which is clearly written in the Constitution BiH, ie Annex Four of the Dayton Agreement, which lists the competencies of the joint bodies of BiH, while all others belong to the entities – they pointed out in the answer from the cabinet of the Serbian member of the Presidency to Srna’s question to comment on Dzaferovic’s statement that “BiH’s legal reaction to Serbia’s agreement” and Republika Srpska on the construction of hydropower plants on the Drina River “.

The response recalls that the BiH Law on Concessions of 2002 established the BiH Concessions Commission, which acts as the BiH Concessions Commission when performing functions and exercising powers related to the award of concessions that are within the exclusive competence of BiH, and that the competencies are BiH prescribed by Article three of the BiH Constitution entitled “Competences of BiH Institutions”.

The cabinet emphasized that the concession property, ie part of the Drina River, is located on the territory of the Republika Srpska, does not extend to the territory of another entity, and that the fact that some Bosnian politicians in a fierce way call and name some BiH institutions such as and the mentioned commission, while the institutions themselves do not declare themselves because they know the legal regulations and are aware that this issue is clear.

The cabinet emphasized that the realization of the project of the Hydropower System “Gornja Drina”, which envisages the construction of hydroelectric power plants Buk Bijela, Foca and Paunci, represents a serious energy resource and is of great interest for the citizens of Republika Srpska, especially the inhabitants of that area and job creation.
